National courts can exercise universal jurisdiction if the state has adopted legislation for the relevant crimes and prosecution for such crimes. Some international agreements allow the states to adopt the necessary law to prosecute or extradite any accused who is within the state party’s territorial jurisdiction. Thus the definition and exercise of universal jurisdiction may vary depending on the domestic legal framework and particular cases concerned to prosecute individuals for international crimes.
